Terms of Service

CogDojo Terms of Service

These terms are an agreement between you and Kean de Jager, 52 Guinifowl Street, Silver Lakes, Pretoria, 0053, South Africa ("CogDojo"). They cover the CogDojo app and the website (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy.

1. Eligibility and accounts

  • You must be at least 13 years old to create an account. If you are under 18, you need permission from a parent or guardian, who accepts these terms for you.
  • Give accurate information, keep your password secret, and tell us if you suspect unauthorised use. You are responsible for activity on your account.
  • One account works on the Android app and the website.

2. What CogDojo is and isn't

CogDojo offers brain-training games and progress statistics for general wellbeing and entertainment. It is not a medical device and does not diagnose, treat or prevent any condition. Scores, percentiles and the Brain Fitness Index compare your game performance with other users. They are not clinical measurements. Speak to a health professional about any medical concern.

3. Plans and subscriptions

  • Free plan: access to the games, with advertising and limited statistics, as described on the Pricing page.
  • Paid plans (Premium, Family): auto-renewing subscriptions (Premium monthly or yearly; Family yearly only), at the price shown at checkout including applicable VAT and taxes.
  • Where you buy determines who bills you:
  • In the Android app: Google Play bills you, and the Google Play Terms of Service also apply. Manage or cancel at play.google.com/store/account/subscriptions. Deleting the app or your CogDojo account does not cancel a Google Play subscription.
  • Free trials: if a plan includes a free trial (for example 7 days), you will be charged when the trial ends unless you cancel at least 24 hours before. We show the charge date before you start. One trial per person.
  • Renewal and cancellation: subscriptions renew automatically until cancelled. If you cancel, you keep paid features until the end of the current period, and then the account moves to the free plan. Your training progress is kept.
  • Price changes: we will give you at least 30 days' notice of a price change. Google Play may also ask for your consent. If you don't agree, you can cancel before the new price applies.
  • Family plan: the owner can invite up to 6 members. Members lose paid features if the owner's plan ends or they are removed.

4. Acceptable use

Do not: cheat or manipulate scores or leaderboards; use bots or scrapers; reverse-engineer the Service except where the law allows it; harass other users or choose offensive display names; share or resell accounts; or interfere with security. We may suspend or close accounts that break these rules. Where possible we will warn you first.

5. Intellectual property

CogDojo owns the Service, including the games, designs, text and logos. We give you a personal, non-transferable, revocable licence to use it for non-commercial purposes. You keep any content you submit, and you allow us to use it to run the Service (for example, showing your display name on leaderboards).

6. Availability and changes

We work to keep the Service available but cannot promise it will be uninterrupted. We may add, change or remove features or games. If we materially reduce what a paid plan includes during your paid period, you may cancel and receive a pro-rata refund for the unused period.

7. Liability

To the extent the law allows, the Service is provided "as is". We are not liable for indirect or consequential loss. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 (including the cooling-off rights in section 44, where they apply), or other laws that cannot be excluded, or our liability for gross negligence or fraud. EU/UK consumers keep their mandatory statutory rights.

8. Ending the agreement

You can stop using the Service and delete your account at any time (see Account deletion). We may end these terms if you seriously breach them, or if we stop offering the Service, in which case we will give reasonable notice and refund unused prepaid periods.

9. Changes to these terms

We will notify you of material changes at least 30 days in advance. Continuing to use the Service after that date means you accept them. If you don't agree, you can delete your account.

10. Law and disputes

These terms are governed by the laws of the Republic of South Africa. Contact us first at [email protected], and we will try to resolve the issue within 30 days. You may also approach the National Consumer Commission or the Consumer Goods and Services Ombud. EU/UK consumers may also use the courts of their home country.
